luxury travel booking services, you agree to be bound by these Terms and Conditions ("Terms"). These
Terms
constitute a legally binding agreement between you and Philippines Luxury Resorts ("Company," "we,"
"our," or "us").
If you do not agree to these Terms, you must not access or use our services. We reserve the right to
modify
these Terms at any time, and such modifications will be effective immediately upon posting on our
website.
2. Definitions
- "Service" refers to our luxury resort booking platform, concierge services, and
related travel services
- "User," "you," or "your" refers to any individual or entity using our services
- "Resort Partners" refers to luxury hotels, resorts, and accommodation providers
featured on our platform
- "Booking" refers to any reservation made through our platform for
accommodation, experiences, or services
- "Luxury Experience" refers to additional services such as private dining, spa
treatments, excursions, and exclusive amenities
3. Eligibility
To use our services, you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Provide accurate, current, and complete information during the booking process
- Not be prohibited from using our services under Philippine law or any applicable international
laws
By making a booking, you represent and warrant that you meet these eligibility requirements.
4. Booking Process and Confirmation
4.1 Booking Requests
When you submit a booking inquiry through our website, it constitutes a request for reservation and
not
a confirmed booking. Our luxury travel specialists will review your request and contact you within
24 hours
to confirm availability and finalize details.
4.2 Booking Confirmation
A booking is confirmed only when:
- You receive written confirmation from our team via email
- Required deposits or full payment has been received and processed
- Availability has been verified with the resort partner
- All booking terms and conditions have been accepted by both parties
4.3 Accuracy of Information
You are responsible for ensuring that all information provided during booking is accurate,
including:
- Guest names (matching government-issued identification)
- Contact information (email, phone number)
- Travel dates and number of guests
- Special requests and dietary requirements
- Payment and billing information
5. Pricing and Payment
5.1 Pricing
All prices displayed on our website are in US Dollars (USD) unless otherwise stated. Prices are
subject to
change without notice until your booking is confirmed. The final price will be confirmed in your
booking confirmation email.
Prices may vary based on:
- Seasonal demand and availability
- Length of stay and advance booking period
- Room category and villa type selected
- Additional services and luxury experiences included
- Special promotions or exclusive offers
5.2 Taxes and Fees
Unless explicitly stated as "all-inclusive," prices do not include:
- Government taxes and resort fees
- Service charges and gratuities
- Travel insurance premiums
- Transportation costs (flights, transfers)
- Personal expenses and incidentals
- Optional activities and experiences not included in your package
5.3 Payment Terms
Payment schedules vary by booking type:
- Standard Bookings: 50% deposit required at confirmation, balance due 30 days
before arrival
- Last-Minute Bookings: Full payment required at time of confirmation (bookings
within 30 days of arrival)
- Private Villas: Full payment required at confirmation
- Peak Season Bookings: Full payment may be required at confirmation during
holidays and special events
5.4 Accepted Payment Methods
We accept the following payment methods:
- Major credit cards (Visa, Mastercard, American Express, JCB)
- Bank wire transfers (advance notice required)
- PayPal for select bookings
- Cryptocurrency payments (upon request and subject to verification)
5.5 Payment Security
All payment transactions are processed through secure, PCI DSS compliant payment gateways. We do not
store
your complete credit card information on our servers. Your payment data is encrypted using
industry-standard
SSL/TLS protocols.
6. Cancellation and Refund Policy
6.1 Standard Cancellation Terms
Cancellation policies vary by resort partner and booking type. General guidelines:
- More than 60 days before arrival: Full refund minus 10% administrative fee
- 30-59 days before arrival: 50% refund of total booking amount
- 15-29 days before arrival: 25% refund of total booking amount
- Less than 14 days before arrival: No refund (full amount forfeited)
6.2 Special Booking Cancellation Terms
- Private Island Resorts (Amanpulo, Balesin): 90-day cancellation notice required
for 50% refund; no refund within 60 days
- Presidential Suites and Overwater Villas: 120-day cancellation notice for full
refund; 50% refund 60-119 days; no refund within 59 days
- Peak Season Bookings: No refunds for cancellations during peak periods
(December 20 - January 5, Holy Week)
- Group Bookings (6+ rooms): Custom cancellation terms apply; contact our
concierge team
6.3 Modification Policy
Changes to confirmed bookings are subject to availability and may incur fees:
- Date changes: $100-$500 modification fee depending on proximity to original booking dates
- Room/villa upgrades: Subject to availability and price difference
- Guest name changes: Permitted up to 48 hours before check-in at no charge
- Downgrade requests: Subject to cancellation fees as outlined above
6.4 Force Majeure and Special Circumstances
In cases of force majeure, including but not limited to natural disasters, pandemics, government
travel
restrictions, or resort closures, we will work with you and our resort partners to:
- Reschedule your booking to future dates (subject to availability)
- Provide resort credit for future use (typically valid for 18-24 months)
- Process refunds based on individual resort partner policies
6.5 Travel Insurance
We strongly recommend purchasing comprehensive travel insurance that covers trip cancellations,
interruptions,
medical emergencies, and other unforeseen circumstances. Travel insurance is not included in your
booking
unless explicitly stated.
7. Resort Partner Policies
7.1 Check-in and Check-out
- Standard check-in time: 3:00 PM
- Standard check-out time: 12:00 PM (noon)
- Early check-in and late check-out subject to availability (additional fees may apply)
- Valid government-issued photo ID required at check-in
7.2 Resort-Specific Rules
Each resort partner maintains its own property policies regarding:
- Dress codes for restaurants and public areas
- Age restrictions for certain facilities (spas, adult-only pools)
- Pet policies (most luxury resorts do not permit pets)
- Smoking policies (designated areas only)
- Noise and conduct standards
Violations of resort policies may result in immediate termination of your stay without refund.
7.3 Minimum Stay Requirements
Some resorts require minimum stay periods:
- Private island resorts: Typically 3-5 night minimum
- Peak season bookings: 5-7 night minimum during holidays
- Presidential suites and luxury villas: 3-7 night minimum depending on property
8. Guest Conduct and Responsibilities
8.1 Expected Behavior
Guests are expected to:
- Treat resort staff, other guests, and property with respect
- Comply with all resort policies and local laws
- Supervise minors at all times
- Respect quiet hours and other guests' privacy
- Report any damages or issues immediately to resort management
8.2 Liability for Damages
Guests are financially responsible for any damage to resort property, including but not limited to:
- Room and villa furnishings and amenities
- Electronics and entertainment systems
- Lost or damaged keys, room cards, or resort equipment
- Excessive cleaning requirements
Resort partners reserve the right to charge credit cards on file for damages discovered during or
after your stay.
8.3 Health and Safety
- Guests must disclose any medical conditions that may require special assistance
- Follow all safety instructions for water sports, spa treatments, and recreational activities
- Children must be supervised at all times near pools and ocean areas
- Guests participate in activities at their own risk; waivers may be required
9. Service Limitations and Disclaimers
9.1 Role as Intermediary
Philippines Luxury Resorts acts as an intermediary between guests and resort partners. While we
carefully
select and vet our luxury resort partners, we are not responsible for:
- The actual provision of accommodation and services by resort partners
- Service quality issues, complaints, or disputes at the resort property
- Changes to resort amenities, facilities, or policies made by the property
- Temporary closures of restaurants, spas, or other facilities due to maintenance or unforeseen
circumstances
9.2 Accuracy of Information
We strive to provide accurate information about resort properties, but:
- Property descriptions, images, and amenities are subject to change without notice
- Actual room views, configurations, and furnishings may vary
- Seasonal variations may affect availability of certain activities or amenities
- We recommend confirming specific requirements directly with our concierge team
9.3 Third-Party Services
Transportation, tours, and other third-party services arranged through our concierge are provided by
independent operators. We are not liable for delays, cancellations, or service quality issues
related to
third-party providers.
10. Limitation of Liability
IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHILIPPINES LUXURY RESORTS
SHALL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT
NOT LIMITED TO
LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR
SERVICES.
Our total liability is limited to the amount you paid for your booking.
We are not liable for:
- Flight cancellations, delays, or travel disruptions
- Lost, stolen, or damaged personal belongings
- Illness, injury, or death during your stay (except where caused by our gross negligence)
- Failure to provide services due to circumstances beyond our reasonable control
- Dissatisfaction with services provided by resort partners or third parties
11. Intellectual Property Rights
All content on our website, including text, graphics, logos, images, and software, is the property
of
Philippines Luxury Resorts or our content suppliers and is protected by Philippine and international
copyright and intellectual property laws.
You may not:
- Reproduce, distribute, or publicly display our content without written permission
- Use our trademarks, logos, or branding without authorization
- Create derivative works based on our website content
- Use automated systems or software to extract data from our website
12. User Accounts and Security
If you create an account on our platform:
- You are responsible for maintaining the confidentiality of your login credentials
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
- We reserve the right to suspend or terminate accounts that violate these Terms
13. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use,
and
protect your personal information. By using our services, you consent to our data practices as
described
in the Privacy Policy.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to its
conflict
of law provisions.
14.2 Dispute Resolution Process
In the event of any dispute:
- Contact Us First: Attempt to resolve the issue by contacting our guest
relations team
- Mediation: If unresolved, both parties agree to attempt good-faith mediation
- Arbitration: Disputes not resolved through mediation shall be settled by
binding arbitration in Manila, Philippines
- Class Action Waiver: You agree to resolve disputes on an individual basis and
waive any right to participate in class actions
14.3 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts located in Makati City, Metro
Manila,
Philippines for any legal proceedings related to these Terms or your use of our services.
15. Termination
We reserve the right to:
- Refuse service to anyone for any reason at any time
- Terminate or suspend your account for violations of these Terms
- Cancel bookings if we suspect fraudulent activity or policy violations
- Modify or discontinue our services without prior notice
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions
shall
remain in full force and effect. Invalid provisions shall be modified to the minimum extent
necessary to
make them valid and enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire
agreement
between you and Philippines Luxury Resorts regarding your use of our services and supersede all
prior
agreements and understandings.
18. Updates to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via:

- Prominent notice on our website
- Updated "Last Modified" date at the top of this page
Your continued use of our services after changes become effective constitutes acceptance of the
revised Terms.
By making a booking or using our services, you acknowledge that you have read, understood, and agree
